New Law Unlocks Property Tax Savings for Inherited Homesteads

Heirship Homestead ExemptionTax Code Section 11.49

  • Heir must occupy property
  • Need copy of Texas Driver License or Texas ID with matching situs
  • Exemption application must be signed by heir apply for exemption
  • *Need death certificate
  • *Need Homestead Heirship Affidavit(s) https://www.wcad.org/wp-content/uploads/2019/12/50-114-A.pdf
  • *Need utility bill matching property address
*Note: Appraisal districts are not allowed to require heir property owners to provide a copy of a deed, affidavit of heirship, or other proof of ownership recorded in the real property records. Texas Senate Bill 1943 changed the law to eliminate any such requirements.
