New Law Unlocks Property Tax Savings for Inherited Homesteads

The Texas Property Tax Code was changed in 2019 by Senate Bill 1943 which affected both the application process and benefits of this exemption.

Heirship Homestead Exemption: Tax Code Section 11.49

  1. Heir must occupy property
  2. Need copy of Texas Driver License or Texas ID with matching situs
  3. Exemption application must be signed by heir apply for exemption

  2. *Need Homestead Heirship Affidavit(s):

  3. *Need utility bill matching property address
    *Note: Appraisal Districts are not allowed to require heir property owners to provide a copy of a deed, affidavit of heirship, or other proof of ownership recorded in the real property records. Texas Senate Bill 1943 changed the law to eliminate any such requirements.
